THE Court of Appeals in Mindanao is now in the process of shipping the records of five cases involving Mayor Oscar Moreno to Manila where these would be reaffled.

In a press statement, the CA-Mindanao station yesterday revealed that the Supreme Court en banc ordered the reaffle of the so-called “Moreno cases” from the appellate court here to the CA-Manila station.

The statement, sent by CA-Mindanao station assistant clerk of court Rosemarie Anacan-Dizon, said the SC’s Nov. 28 order was based on the recommendation of former CA Acting Presiding Justice Remedios Salazar-Fernando.

Fernando’s recommendation was in her Oct. 30, 2017 letter to the SC docketed as Administrative Matter No. 17-11-07-CA, “Re: Special Concerns Regarding the Court of Appeals – Cagayan de Oro Station.” These involve Ombudsman administrative disciplinary cases against the then Misamis Oriental governor Moreno, et al..

These are docketed before the CA-Mindanao as: CA-G.R. SP No. 08156-MIN; CA-G.R. SP No. 08165-MIN; CA-G.R. SP No. 08308-MIN; CA-G.R. SP No. 08321-MIN; and CA-G.R. SP No. 08363-MIN.

Fernando’s letter was in response to the Oct. 19 letter of CA-Mindanao executive Justice Romulo Borja who raised concerns about the CA-Mindanao station’s “chronic difficulty in composing divisions to act on sensitive cases engendered by the number of recusals by Justices in the Station and frequent court-wide reorganizations.”

The CA-Mindanao station said the Justices here were unanimous in endorsing the plan to transfer the Moreno cases to the CA-Manila station.
