A resolution earnestly requesting Judge Anabel Carmen Casino-Baluran of the MTCC-Branch 3 to hold in abeyance the implementation of the Writ of Demolition of the decision issued in the Civil Case No. C16-JAN-019 for unlawful detainer with damages, has been approved by the 18th City Council during its 104th Regular Session.

This is to enable the city government of Cagayan de Oro to conduct socio-economic survey of the affected residents of Mortola Street, Barangay No. 40,  and to identify a suitable relocation area for them.

In the previous judgment on Nov. 17, 2016, the court ordered defendants and all persons claiming rights under them to peacefully vacate from the premises of the subject property and to restitute the possession thereof to plaintiffs and for each defendant to pay plaintiffs the sum of P2,000 per month as reasonable compensation for the use and occupation of the subject property from Sept. 2, 2015 until the possession thereof is fully restored to plaintiffs and for defendants to pay jointly and severally P10,000 plus attorney’s fees.

On Oct. 20, 2017, the court issued the writ of execution for the enforcement of judgment. (sp)
