A REGIONAL court on Wednesday gave prosecutors and the defense lawyer in the illegal arms and explosives cases against architect Rey Galua over a week to submit their respective memoranda before it decides on the motion to allow the respondent to stay in a hospital.

Judge Henry Damasing  of the 24th branch of the Regional Trial Court gave Galua’s lawyer Arturo Ubaub and prosecutors Jonathan Pacuribot and  Omar Naga 10 days to submit their memoranda.

The order came after Damasing heard the testimonies of three Northern  Mindanao Medical Center cardiovascular specialists that were presented by Ubaub in court.

Ubaub said he presented physicians Frans Go, Roy Sasil and Deborah Urbina in order to convince the court why Galua should not be detained at the city jail yet because of his heart ailment.

But Prosecutor Pacuribot said the physicians’ testimonies favored the prosecution’s position that Galua can be treated even outside a hospital.

“OK man ang mga doctor nga ipadayon ang medication ni Galua sa gawas sa hospital,” Pacuribot said.

The physicians told the court that Galua has  symptoms of a rheumatic heart  disease, the reason for the architect’s palpitations and chest pains.

Galua was arrested during a raid in his uptown Cagayan de Oro house last month. Police said they seized a cache of guns and grenades during the raid.

The architect has been tagged by the police as a “person of interest” in the investigation into the Dec. 2, 2017 fatal gun attack on  Dr. Ricardo Rotoras, president of the University of Science and Technology of Southern Philippines. (nitz arancon)
