ILIGAN City — The Court of Appeals has overturned a decision of the Office of the Ombudsman to dismiss Mayor Celso Regencia for grave misconduct.

In a 15-page ruling released on Feb. 15, 2018, the CA 22nd Division in Cagayan de Oro, voided and set aside the ombudsman’s March 29, 2017 decision that slapped Regencia with the penalty of dismissal from government service.

In the decision last month, the CA stated that Regencia “cannot be held liable for grave misconduct since there is no evidence showing that he wrongfully intended to transgress some established and definite rule of action which is attended by corruption, clear intent  to violate the law.”

The case was filed against Regencia by former vice mayor Ruderic Marzo who said there was usurpation of authority when the respondent performed mayoral functions while Regencia was under detention at the city jail.

Regencia was detained in connection with the attempt on the life of former congressman Vicente Belmonte at the Laguindingan airport in Misamis Oriental. The mayor was subsequently cleared.
