COUNCILOR Leon Gan said the complainant and the personnel of the Land Transportation Office-10 who allegedly did not accept City Health Office -issued medical certificate must be invited so that the matter will be clarified.

This is in response to the special report of Councilor Reuben Daba during the regular session of the City Council regarding LTO-10’s alleged non-acceptance of medical certificates issued by the local health office.

Gan said the refusal of the LTO to accept this demonstrates misconduct and abuse of authority, which is a violation of the Administrative Law. He said pursuant to the law there is a presumption of regularity of the certificates issued by a government agency.

Gan cited that the LTO does not need to review or verify whether the certificate is from an accredited institution because of the inherent presumption of regularity.

He suggested inviting the complainant and most especially the LTO personnel so that they can directly ask the LTO who advised them not to accept the CHO-issued medical certificates. (sp)
