ILIGAN City — Closure of a section of the C-3 Road passing through the property of spouses Uriel Borja and Veronica Tamparong was ordered by the Regional Trial Court, Branch 6, of this City.

In her order dated June 6, copies of which reached the press yesterday, Judge Leonor Quinones stated that “unless and until the road construction and repairs are completed, no public utility buses shall be allowed to use the C-3 diversion road in order to secure and guarantee public safety.”

It was learned that the said section of the road is under Expropriation proceedings before the said Court by the Republic of the Philippines represented by the Department of Public Works and Highways.

According to the order, the court conducted an ocular inspection pursuant to a complaint that “the road has become impassable due to the barricade or  obstacles installed by Uriel Borja inside his property which are subject to this expropriation proceeding.”

“At the first stop the court observed cracks on the cemented road with asphalt and epoxy patching. There was also a visible sign of soil erosion resulting in a decline in the road elevation,” the order reads in part.

“The second stop revealed a fully receded lane of a three-lane road. The Court observed the one-way signage was installed to the extreme danger posed by the massive soil erosion beneath the cemented path.”

The fourth and last stop showed part of the ongoing construction of the lined canal and an excavated portion of an unpaved road exposing an installed culvert intended as cross- drainage, 

The court also stated that the “proposed signage of the DPWH in replacement of barricade installed by Mr. Borja must be first presented before the court before actual installation.”

Finally, the court ordered that subpoena duces tecum/ad testificandum be issued to Joseph Baldon and Engr. Abdulrahman Maute, directing to bring the construction and drainage plans for the C-3 diversion road, especially that affecting the property of defendant Borja on Aug. 29 at 8:30 am on to testify.
