A REGIONAL court has voided a municipal ordinance and a provincial board resolution on the creation of 10 legislative staff positions in the Office of the Sangguniang Bayan of Medina.

The Regional Trial Court Branch 26 in Medina declared as invalid Municipal Ordinance no. 802-2012 and Sangguniang Panlalawigan Resolution no. 381-2014, and ordered local officials to pay Medina Mayor Ken Niño Uyguanco P50 thousand for the cost of the filing of the case.

Uyguanco petitioned for the annulment of the Medina Sangguniang Bayan Ordinance 802-2012 and Sangguniang Panlalawigan Resolution 381-2014, He sought a declaratory relief, mandamus, injunction and damages, asserting that the legislators improperly exercise their powers under the Local Government Code.

Judge Dan Calderon, in a Nov. 6, 2015 ruling, declared the town ordinance and provincial board resolution invalid and ordered Vice Mayor Kim Michael Odchigue and all the members of the Sagguniang Bayan, and provincial board members Benedict Lagbas, Vincent Pelaez, Virginia Dumadag, Jabi Bernaldez, Donato Chan, and Emmanuel Mugot to pay Uyguanco.

On Dec. 18, 2012, the town council passed an ordinance  that created 10 legislative staff positions in the Office of the Sangguniang Bayan.

Uyguanco, who was then the vice mayor, did not sign the ordinance.

Uyguangco said there was grave abuse of authority, noting that there was a replacement document with falsified entries in violation of Article 170 of the Revised Penal Code.
