THE City Council, during its regular session this week, enacted an ordinance authorizing the city mayor to enter into a Memorandum of Agreement with the Department of Social Welfare and Development (DSWD) covering the implementation of the National Household Targeting System for Poverty Reduction, also known as Listahanan.

Under the agreement, the DSWD shall act as and have the duties and accountabilities of a personal information controller for all personal data processed by Listahanan. It shall also have in place the reasonable and appropriate physical, technical and organizational measures intended to protect personal data up to the date of sharing with the city against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, as well as against any other unlawful processing, among others.

For its part, the city shall act as and have the duties and accountabilities of a personal information controller for all personal data received from DSWD and covered under the agreement. It shall also uphold the rights of the data subject in accordance with RA 10173 and relevant rules, receive and further process personal data from DSWD and the data sharing and privacy policies and guidelines of DSWD. It shall likewise have the legal authority to give warranties and fulfill the undertakings set out in the agreement, among others.

The legislation was endorsed  by the committees on social services and on laws and rules chaired by Councilors Reuben Daba and Ian Mark Nacaya, respectively. (cli)
