THE City Prosecutor’s Office (CPO) yesterday decided to bring Senior Insp. Ereneo Ramirez and his men to court in connection with the disappearance of 33-year old Enrique “Eking” Fernandez III in October.

Ramirez, head of the just-deactivated Crime against Persons and Property Desk (CAPPD) of the Cagayan de Oro City Police Office (Cocpo), would stand on trial for kidnapping together with his subordinates SPO2 Jojo Lim, SPO1 Alaindelon Tacubao, PO3 Alejandro Ubanan and PO2 Sangkula Hussein II.

Prosecutors also included “assets” (police informers) Rolando Udasco, one Boy Guevarra and a John Doe for allegedly providing the officers with information about Fernandez’s whereabouts in Oct. 23. The three are at large at presstime.

Prosecutors recommended no bailbond in the five-page resolution, and unless the court orders otherwise, the officers would mostly likely spend their first Christmas and New Year’s days behind bars.

Fernandez’s father and namesake Enrique Jr. filed the case for kidnapping against the eight suspects.

Work was briefly halted at city hall as workers stepped out of their offices to catch a glimpse as the NBI brought the handcuffed Ramirez and his men for their commitment to a prison facility.

Some people in the crowd were heard cussing at the police officers who sparked public outrage because of a closed-circuit television recording that showed the broad daylight abduction of Fernandez outside an e-Bingo establishment in uptown Cagayan de Oro.

Acting city prosecutor Merlyn Uy said  the CCTV recording presented as evidence was valid and would be used in court against the officers.

Uy said the arrest of Ramirez and the other suspects at Camp Alagar on Tuesday was also proper and legal.

She said prosecutors have yet to decide on the carnapping complaint against the suspects.

The suspects were brought to the City Health Office for medical examination before they were moved to the city jail in Lumbia.
