Nazareth Barangay Chairman Maximo Rodriguez III will personally tender counter proposal to Mayor Oscar Moreno to continue the implementation of the P21 million Barangay Hall project of the Department of Public Works and Highways at the lawn tennis court area.

Rodriguez issue this statement over the weekend after no less than Mayor Oscar Moreno said the Cagayan de Oro City government won’t allow the demolition of a tennis court facility in Barangay Nazareth.

In opposing the demolition, Mayor Moreno pointed to Section 31 of Presidential Decree No. 957 as amended which read in part that areas reserved for parks, playgrounds and recreational areas “shall be non-alienable public lands and non-buildable.”

The areas referred to in Section 31 of Presidential Decree No. 957 as amended are those involving subdivision projects in which the owner/developer is required to reserve five percent of the gross area for open space, to be allocated for parks, playgrounds, and recreation.

However, Rodriguez claimed that to avoid misunderstanding both contesting parties they will submit for a 50-50 proposal in using the tennis court area. The proposed three-story barangay hall would be constructed where the illegal structures situated.

“We have legal personalities and the national government has funded for the project. Our proposal is that nay mabilin sa court because the area would be utilized for public services,” he said.

Rodriguez said they will endorse a compromise agreement with the city government and the NTLC by seeking audience personally to Mayor Moreno and the City Legal Office anytime this week.

He said they had been practicing proper process in calling out the attention of the officers of the Nazareth Lawn Tennis Club for the past years.
