THE Sandiganbayan has cleared former mayor Vicente Emano in connection with the graft case filed against him in 2013 by a city hall employee who was assigned from the city-owned JR Borja General Memorial Hospital to the City Library.

Emano’s lawyer Francis Khu on Friday said the anti-graft court acknowledged that Emano did not intently and maliciously refused to reinstate administrative assistant Leonor Esparcia.

Esparcia brought Emano to court over his alleged refusal to reinstate her. She said that from an administrative assistant, she was virtually turned into a guard at the City Library.

Khu said the Sandiganbayan decision meant “end of story.”

The capitol’s information office quoted Khu as saying that Emano’s act “was due to the election ban” of 2013, and “everything was frozen, including the mayor and all other officials and personnel of city hall.”

He added: “They [could not] make any movement, including reinstating Esparcia.”

Khu however said that Emano had issued a directive to reinstate Esparcia on condition that it would not violate any law.

Khu said it was the last of Emano’s cases, and that he “has no more pending cases,” administrative or criminal.
