SUSPENSION or dismisal orders against government officials coming from the Sandiganbayan and the Office of the Ombudsman are not covered by the Commission on Elections prohibition during election periods.

Walay control ang Comelec kon ang order of suspension or dismissal batok sa usa ka government official or employee gikan sa anti-graft court o Ombudsman for that matter,” Comelec-10 Regional Director Renato Magbutay said.

Covered by the prohibited act of Comelec, Magbutay said, are administrative suspensions against government officials or employees only.

Magbutay said Comelec also prohibits local chief executives from ordering transfers, relief, or re-detailing of work any of their employees.

He said the Comelec prohibition ends when the election period is over that is on June 12.

Magbutay added that government officials who would violate the prohibited acts would be sanctioned by the Comelec.

For his part, former Vice Mayor Antonio Soriano opined that it would not matter if a government official gets dismissed or suspended by the Sandiganbayan or the Ombudsman because they could still run and seek reelection.

Soriano cited the case of appointed Misamis Oriental Board Member President Elipe.

It can be recalled that the Sandiganbayan has found Elipe guilty of falsifying the daily time record of his sister when he was still serving as a city councilor.

However, Soriano added, the political opponent of the dismissed or suspended official can also use the case in the campaign period.
