By LITO RULONA Correspondent THE city council on Monday passed a resolution to inform the Department of Justice (DOJ) and other departments that the Moreno administration has refused to implement City Ordinance no. 12860-2014 or the 2015 Cagayan de Oro Revenue Code. A majority of seven councilors voted in favor of the resolution informing the Department of Justice (DOJ), Department of Interior and Local Government (DILG), Bureau of Local Government Finance (BLGF), and the Department of Finance (DOF) about the non-implementation of the revenue code approved by the city council. The passage of the resolution came following call by Councilor Leon Gan for the city’s taxpayers to demand for a tax refund from city hall in view of the DOJ’s decision to trash Mayor Oscar Moreno’s appeal. Moreno has questioned the 2015 revenue code, asserting that the city council’s act of approving it in late 2014 was illegal. City treasurer Glenn Bañez said city hall would go to court to question the legality of ordinance before the Court of Appeals (CA). Moreno’s allies, councilors Roger Abaday and Teodulfo Lao, opposed the passage of the resolution, saying the CA need to resolve the issue first. “Angayan nga hulatan ang implementation if CA would resolve the issue. Walay dautan nga epekto apan respituhan nato ang gi-file nga motion before the CA. Let us wait for the CA to release their findings,” Abaday said. He said informing other government line agencies is a futile move considering that the issue has yet to be resolved. “Wala pa man gihapon. Hulatan pa man nato. Kung mo come-out nga mopabor kanila, dili na kini nato supakon. Dili pa final ang desisyon sa DOJ. Pwede pa mag-appeal,” he said. Gan however pointed out that the non implementation of the revenue code is already a violation of Article 187 of the Local Government Code.
