Rufus Rodriguez yesterday cried foul over the graft and malversation charges he is facing before the Ombudsman, saying he was not afforded “due process of law.” Rodriguez, and his brother Abante Mindanao Partylist Rep. Maximo, are among the eight officials charged with graft and malversation, and are part of the third batch of cases in connection with the now infamous pork barrel scam allegedly masterminded by Janette Napoles. In a text message to Gold Star Daily, Rodriguez said he would go directly to the Supreme Court to clear his name. “I am filing a petition of certiorari and prohibition in the Supreme Court that will supend the proceedings in the Ombudsman pending the remand of the complaint back to the DOJ for proper proceedings with due notice and hearing to be afforded to me so that I can answer all allegations against me and present my evidence,” Rodriguez’s text message reads in part. He claimed that the Department of Justice did not summon him in connection with the graft charges. “I expected the DOJ to summon me so that I can face my accusers and read the evidence against me but I was not given a chance to present my side. There was no due process. I was not given due notice and hearing,” he said. Rodriguez said that when he received the 18 documents from the Commission on Audit regarding the allegations, he had all the documents examined by the National Bureau of Investigation (NBI). He said the NBI found all of the signatures in the 18 documents from COA to be forgeries. “I do not know and have never met personally any officer/functionary of any NGO associated with or owned Ms. Janette Napoles, and I never received any amount of money from her,” said Rodriguez.
