Comelec commissioner denies Moreno disqualification

COMMISSIONER Luie Tito Guia of the Commission on Election has denied signing any disqualification resolution against Mayor Oscar Moreno in either the first and second divisions of the commission.

Guia’s declaration comes at the heels of a Facebook post of DDS News – CDO on the evening of May 10 of a photo of a supposed disqualification order from Comelec against Moreno.

The photo showed, of what appeared to be hard copies, an alleged decision of Comelec’s Second Division on the disqualification petition filed by William Guialani and was dated on International Labor Day, May 1.

“No case on Moreno. Cases go to either first or second division,” Guia said in a cyber interview.
When this reporter showed Guia the screen capture of the supposed decision, the commissioner disavowed the document.
“I don’t remember having signed anything and that the style used is not the one we usually use,” replied Guia.

He said that he will ask his colleagues in his division.

Comelec’s two divisions that deal with election cases and pre-proclamation controversies act as a collegial body. 

Later, the Comelec commissioner said, ” Officially I am saying that Resolution you showed me is fake. The second division did not issue that resolution.”

“There is a pending case on Moreno’s DQ before the 2nd Division, he added, “But it hasn’t been decided yet.”
