THE Commission on Elections (Comelec) Law Department early this week has filed a motion to withdraw the disqualification petition against Carmen Barangay Chairman Raineir Joaquin ‘Kapkik’ Uy due to insufficient evidence.
The motion, submitted to the Comelec Second Division, is currently under review.
The news has sparked mixed reactions from the public.
Uy’s supporters have praised his leadership, while critics have vowed to continue scrutinizing the case.
Lawyers Al An E. Genoso and Angelie Marie Carrasco, lawyers representing Uy, acknowledged the public response.
They noted that electoral watchdogs and stakeholders will closely monitor the case.
Despite the differing viewpoints, both lawyers remain confident in Uy’s position and his ability to navigate the electoral process.
They emphasize their focus on ensuring a fair and impartial outcome.
Uy’s camp, led by Genoso, maintained as he expressed support for the development.
He said that the motion, submitted to the Comelec Second Division, may reverse the disqualification case.
During Wednesday’s press conference, Barangay chair Uy told reporters he felt vindicated by the Comelec's decision to file the petition to withdraw case.
Uy thanked supporters and reaffirmed commitment to serving Cagayan de Oro, stating, “This validates our stance that the petition lacked merit.”
Another Uy’s lawyer Carrasco said that the Comelec Second Division will review the motion, potentially granting or denying withdrawal.
Carrasco even pointed out that the impending withdrawal would clear Uy’s path to the 2025 elections, boosting his candidacy.
They emphasized evidence-based decision-making in electoral disputes.
