A faculty member of the University of Science and Technology of the Philippines (USTP) has been found guilty of five counts of serious sexual misconduct which could lead to the filing of criminal and civil cases against him as well as dismissal from government service.
The university’s Board of Regents took action against a member of its faculty, identified as Giovanni B. Cagurin, following a special online meeting on September 30, 2024.
The BOR’s decision came at the heels of a formal investigation that included the findings of the Committee on Decorum and Investigation regarding student-related incidents.
The committee had dismissed some minor charges against Cagurin but found him guilty of five counts of grave sexual misconduct.
The committee also recommended Cagurin’s dismissal from government service. This means Cagurin will be barred from holding any public office and from taking civil service exams.
The faculty member will likewise forfeit his retirement benefits although he can still recoup his social security contributions.
Meanwhile, Cagayan de Oro 2nd District Rep. Rufus Rodriguez condemned the alleged sexual misconduct and expressed his deep disappointment over the violation of students' rights to safety and security.
Rodriguez is a member of USTP’s Board of Regents.
Rodriguez said he is contributing P100,000 to USTP’s legal fund to ensure that the victims get justice and the support they need.
Rodriguez hopes the money will accelerate the investigation so that criminal charges can be filed against Cagurin based on the Anti-Sexual Harassment Act of 1995.
Rodriguez said this case highlights the influence and impact of authority and influence in educational settings as described in a legal precedent (Aquino vs. Acosta). It emphasizes the need for those in power to act responsibly.
Acting as a member of the BOR, Rodriguez also filed Resolution 146-A, a resolution that focuses on helping the victims.
The resolution calls for mental, legal, and financial support for those affected by Cagurin’s sexual misconduct.
This resolution also demands that all USTP officials and staff receive appropriate warnings to prevent any inappropriate behavior towards students in the future.
Rodriguez said this will hopefully ensure a safe learning environment in the university and in other schools and colleges.
