Gingoog City — Assistant City Prosecutor Alfredo Gomez has dismissed the libel charges filed by Barangay 5 chairman Gerime Cabeltes against MiddyNews publisher Rita Endrina recently for “lack of probable cause.”

Cabeltes filed a libel suit against the publisher of Gingoog local newspaper here days after his arrest through buy-bust operation at his residence on Dec. 5, 2016.

He alleged in his affidavit that owner and publisher of the MiddyNews defamed him when the following statement was published in Dec. 6, 2016 issue of Endrina’s paper.

Nasikop ang suspetsadong Cabeltes human mapalite sa shabu sa kantidad nga usa ka libo ka pesos.”

In his affidavit, Cabeltes also mention that he suffered “wounded feelings, anxiety, fear, restlessness, emotional setbacks, and irreparable injury” because of the news report.

However, Gomez said the full context of the news article was “fair and true report without malice.”

Endrina said she based her news article on a police report.

She received the copy of the prosecutor’s resolution on Wednesday for dismissal of charges dated May 18.
