BUTUAN City — The Butuan City Prosecutor’s Office found probable cause in the complaint filed by the mother of 10-year old Yanna Chan who died two years ago after allegedly denied admittance at the Butuan Doctors Hospital because they had no money to deposit.

In his 11-page resolution on Jan. 14, this year, Assistant City Prosecutor Benjamen P. Uy recommended the filing of criminal charges against Dr. Claudio Estacio, owner of Butuan Doctors Hospital and two hospital personnel for violating Republic Act 8344, “An act prohibiting demand of deposits, collecting advance payments for confinement and treatment of patients in hospitals or medical clinics.”

The mother of the victim, Remedios Chan, alleged they only received said Butuan City Prosecutors’ resolution last week despite said resolution was penned more than three months ago.

The Butuan City Prosecutor’s Office said in their resolution that aside from recommending filing of criminal charges against owner of Butuan Doctors Hospital, Dr. Claudio Estacio who is also currently member of the Board of Directors of Butuan City Water District (BCWD), criminal charges were also recommended to be filed against Hospital Supervisor Maria Nita Gorme and admission staff Jackie Lincuna.

Uy stated that asking deposits, cash advance and none admittance that resulted to death of the 10 year old girl found probable cause for violating section 4 of Batas Pambansa 702 as amended by RA 8344 thus recommending for the forwarding information in the filing of criminal charges against Estacio, Gorme and Lincuna.

According to the complaint of the parents of Yanna Chan, they reached Butuan Doctors Hospital here in Butuan City evening of July 15, 2014 after more than two hours of travel from San Francisco, Agusan del Sur only to be allegedly rejected admittance because they cannot give “deposit money.”

‘’We arrived at Butuan Doctors Hospital around 8 pm, rushing to admission desk.. running for my daughter’s life… only to be rejected simply because my available cash on hand was only around 8,000-10,000 and they demanded for 30,000 deposit on that very hour,’’ said Remedios Chan in her affidavit.
