THE 24th branch of the Regional Trial Court here yesterday held in abeyance the court proceedings pertaining to the illegal arms and explosives possession cases against architect Rey Galua.

Judge Henry Damasing’s ruling favored the motion of Galua’s lawyer, Arturo Ubaub, who alleged that prosecutors elevated the two cases to court without a preliminary investigation.

Galua, who was arrested after authorities found a cache of firearms and grenades in his uptown Cagayan de Oro home early this month, was labeled a “person of interest” in the investigation into the Dec. 2, 2017 murder of Dr. Ricardo Rotoras, president of the University of Science and Technology of Southern Philippines.

Judge Damasing’s decision bought Ubaub more time, allowing him to assail and appeal the prosecutor’s resolution before the Department of Justice.

Ubaub said he has until Feb. 9 to file appeal with the justice department on behalf of Galua.

Earlier, he criticized the resolution approved by city prosecutor Charisse Galarita-Bitoon, alleging that it was made in haste. While the prosecution office recommended a P200-thousand bailbond in connection with the illegal arms possession case, none was recommended for the illegal explosives possession case.
