THE four students who were dismissed from an aviation college here can heave a sigh of relief for now after a regional court ruled in favor of their petition on Monday.
Judge Gil Bollozos of the 21st branch of the Regional Trial Court granted the request for a temporary restraining order of dismissed Acatech Aviation College students Muhammad Adel Roa, Amir Roa, Karen Faith Suico and Kristian Gavas.
In a two-page decision, Bollozos ordered Acatech College president Jonathan Palma and prefect of discipline lawyer Jose Pallugna to let the four students enter the school premises and go back to studying the four subjects they have not finished because of their dismissal.
Bollozos also ordered Palma and Pallugna to rescind the preventive suspension of Gavas and to let Muhammad Adel Roa graduate on April 12.
“The defendants are likewise directed to refrain from making any abusive retaliatory or discriminative actions against the plaintiff,” Bolluzos warned in his ruling.
Earlier, the four students filed a civil case for damages against the school after they were dismissed.
The management of Acatech Aviation College dismissed the four students after they wrote a letter to Transportation Secretary Arthur Tugade to complain about the school’s facilities and alleged bad policies towards student organizations.
According to Pallugna, the school was put to shame because of the students’ letter to Tugade.
“Nag-hearing ko sulod sa school premises ug nahukman sa school management nga i-dismiss ang maong mga estudyante,” Pallugna said.
Pallugna said the school is willing to comply with the court decision. However, he said the school will file for a motion for reconsideration.
Pallugna argued that courts do not have jurisdiction over the matter since only the Civil Aviation Authority of the Philippines has the mandate over aviation schools.
“The court cannot issue a TRO to disturb the status quo, but only to maintain the status quo,” Pallugna asserted.
