Local Government of Iligan City has filed a Petition for Certiorari before the Supreme Court against the Commission on Audit (COA), CONAL Holdings, Mindanao Power Corporation (MPC) and the incumbent City Officials in 2013 when the Independent Power Plant 1 and 2 (IDPP 1 &2) formerly owned by the Alcantara Group of Companies but foreclosed by the Local Government Unit after it imposed a levy on the said property due to tax delinquency.

This was announced by City Legal Officer Atty. Voltaire I. Rovira during the Flag Raising Ceremony of the Officials and Employees of this City last Monday, June 24.

According to Rovira the sale of the said Power Plants was illegal but it was declared legal by COA.

He said that the City has brought the case to the

Supreme Court as the said Power Plant can still be repossessed by the City Government.

He added that the Supreme Court has already ordered the Defendants COA, CONAL HOLDINGS, MPC and the City Officials who sold the Power Plant to file their Answers to the Petition.

He was  confident that the City can still recover the said Power Plant because the Supreme Court has given the petiion filed by the LGU due course.

On the other hand, Atty, Moises Dalisay, Jr., one of the Defendants being  an incumbent in 2013 when the power plant was sold said  that the upon review of the said sale COA declared that the same was in order and legal.

He said that a Law Firm based in Davao will file the Joint Answer of all the Defendants to the petition mentioned by Rovira.

He said further that the instant case mentioned by Rovira was similar to a case filed earlier before the Court of Appeals (CA) that was already dismissed.
