THE lawyer arrested in an anti-narcotics operation here last week is set to be moved to the city jail in Lumbia today after prosecutors ruled to bring him to court on Monday.

Lawyer Marlon Yap was charged in court with illegal possession and illegal selling of prohibited drugs.

The case against the lawyer was approved by city prosecutor Charisse Bito-on after he signed a waiver.

The waiver would allow authorities to transfer Yap from a detention cell at the Maharlika police headquarters to the Lumbia prison facility.

Yap has been behind bars for nearly two weeks now after police pounced on him on Apolinar Velez and Mabini streets in downtown Cagayan de Oro and arrested him for allegedly possessing and selling shabu.

Yap has strongly denied the accusation, saying the pieces of evidence were not his.

The lawyer earlier sought a preliminary investigation by prosecutors. He then signed a waiver after he discussed his case with another lawyer who would defend him in court.

“Mas sayon man gud nako estoryahon ang akong abogado kon dinhi ra ko ma-detain sa Maharlika kay sa didto sa Lumbia. Pero karon kay nag-estorya nami sa   akong abogado, sugot nako nga didto i-detain sa Lumbia,” Yap said.

He said he was prepared to prove the police wrong, adding that surveillance and security camera video recordings he gathered would show that he is innocent.
