THE Supreme Court has dismissed the cases filed by a close associate of former Taglimao barangay chairman William Guialani against three Court of Appeals associate justices in relation to the controversial city hall-Ajinomoto tax settlement case.
The eight-page decision cleared associate justices Edgardo Camello, Oscar Badelles and Perpetua Atal-Paño of the 21st Division of the Court of Appeals station here. The ruling was signed on Nov. 29, 2016 but a copy of the decision was only shown this paper yesterday.
The associate justices were charged by Clemente Atoc with gross ignorance of law, gross violation of the attorney’s oath, gross violation of professional responsibility, gross violation of the Code of Judicial Conduct, gross violation of professional ethics, gross violation of judicial ethics, grave abuse of authority, goss misconduct, and manifest partially, among others.
The charges were filed after the appellate court issued a temporary restraining order as an offshoot of Guialani’s grave misconduct case against Mayor Oscar Moreno and city treasurer Glenn Bañez because of a tax settlement between city hall and Ajinomoto Philippines.
Signing the decision were Chief Justice Ma. Lourdes Sereno and SC associate justices Antonio Carpio, Presbitero Velasco Jr., Teresita Leonardo de Castro, Arturo Brion, Diosdao Peralta, Lucas Bersamin, Mariano del Castillo, Jose Catral Mendoza, Bienvenido Reyes, Estela Berlas Bernabe, Marvic Leonen, Francis Jardeleza, Alfredo Benjamin Caguioa and Jose Portugal Perez.
The SC stated that Atoc had no evidence against the CA associate justices, and that the TRO issued by the CA was valid.
