The decision was made by Judge Eleuteria Algodon of the 2nd branch of the Municipal  Circuit Trial Court here.

On Monday afternoon, Algodon granted the plea of the affected residents to hold in abeyance the implementation of the writ of demolition issued in favor of Hemari Properties and Development Corp..

Yesterday, she gave the affected residents less than 12 more days from yesterday to move out as a result of a hearing on the urgent motion filed by lawyer Dale Bryan Mordeno on behalf of about a thousand people living in Baloy.

Algodon said Mordeno should make sure that his clients are gone by July 23 or else, the writ of demolition would be implemented.

The writ covers over 200 houses, about 10 of which were demolished yesterday morning.

Jenny Go, a lawyer of Hemari Properties and Development Corp., said Mordeno had asked for 15 more days but her position was half a month was too much given that the firm has already given the residents much time already.

Go said Hemari Properties have even provided the families with a relocation site  in Palalan, Tablon, but the affected residents rejected it.
