THE 2nd Division of the Sandiganbayan has denied former mayor Constantino Jaraula’s petition to dismiss his case in connection with the fertilizer scam.

“Wherefore, finding no cogent reason to disturb the assailed Resolution, the Motion for Reconsideration and the Manifestation with Ad Cautelam Motion are hereby denied for want of merit,” reads part of the anti-graft court’s ruling.

Associate Justice Lorifel Pahimna signed the four-page decision and was concurred by Associate Justices Oscar Herrera Jr. and Michael Frederick Musngi. The decision was promulgated this Jan. 10.

The decision stems from a graft case filed by the Office of Ombudsman accusing Jaraula of conspiring with Department of Agriculture officials and PDSFI in buying fertilizers, amounting to P3 million, for non-existing farmer-beneficiaries from December 2003 to July 2004, an allegation the former mayor denied.
