A LAWYER and a Padayon Pilipino candidate for councilor here has laughed off ex-councilor Edgar Cabanlas’s pronouncement that Mayor Oscar Moreno could appeal a court decision that dismissed a civil case filed against the city council majority in connection with this year’s city hall budget.
Lawyer Oscar Musni, a former member of the provincial board, said Moreno cannot file a motion for reconsideration because he is merely a nominal respondent to the civil case filed by Councilor Roger Abaday and other members of the city council minority.
Cabanlas, a former city councilor who also served in the provincial board together with Musni, earlier said he would file a motion for reconsideration on behalf of Moreno in an effort to convince Judge Jeoffre Acebido to reverse his decision. Cabanlas is lawyering for Moreno in the civil case.
Musni said that as a nominal respondent, Moreno is not really involved in the case, and that the only reason why his name was included is because, as local chief executive, he was made aware that a civil case was filed.
“Wala man syay labot bisag mayor pa sya kay isyu man ni sa Sanggunian,” said Musni.
