“IF THE owner will not cooperate, we use our power of imminent domain so that services will not be delayed.”

This was stressed by Councilor Ian Mark Nacaya, chair of the committee on planning and development, in his special report during the regular session this week presided over by Vice Mayor Raineir Joaquin Uy, citing the delay in the implementation of road projects connecting the Macapaya relocation area in Upper Camaman-an to the city proper.

Nacaya said the city can authorize the city legal office to file  expropriation proceedings before the court and deposit 15-percent of the cost of the property. For this purpose, an updated assessment shall be submitted by the City Assessor’s Office for the immediate realization of the road project, he added.

The councilor received a copy of the resolution of the Macapaya Hills Oro Settlers/Homeowners Association, Inc.  requesting the city government for the expropriation of the Torres-Roblon properties. The settlers are also requesting that passenger jeepneys be available to ply the route to and from the city proper and NHA-CDO Bayanihan Village, Macapaya, Camaman-an.

In response, the City Council  adopted a resolution urging the City Legal Office to fast track its processing of road-right-of-way acquisition for the road opening projects in the city especially the proposed Bugo-Puerto and Macapaya proposed road projects.

Nacaya also proposed that the request of the association for a franchise route in the area be referred to the committee on public utilities chaired by Councilor Teodulfo Lao, Jr., for discussions with the Land Transportation Franchising and Regulatory Board.

He further recommended that the acquisition of a two-hectare lot for the construction of school buildings for junior and senior high school students be referred to the committee on education chaired by Councilor Suzette Daba for study. This is due to the fact that the relocation area is now expanding as Phase 2 is now undergoing construction, he added.

“If we delay the services, it will cause the government more funds, so with this report I hope this will be resolved as early as possible,” Nacaya said. (sp)
